Bill Caption

Relating to the authority of certain municipalities to create a presumption in a prosecution for certain offenses involving the parking of a motor vehicle.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

HB 714 would amend Local Government Code related to parking violations on private property within certain cities.

This bill is a bracketed bill that would only pertain to larger cities. These cities would be authorized to create a civil offense for parking an unattended vehicle in the front or side yard of a single family residence in a residential area.

Vote Recommendation Notes

We oppose HB 714 because the bill violates our principles of private property rights, individual liberty, and personal responsibility. It is not the role of government to dictate what individuals do on their own property so long as such activity does not infringe on the rights of others.
