Relating to the creation and re-creation of funds and accounts, the dedication and rededication of revenue, and the exemption of unappropriated money from use for general governmental purposes.
Fiscal Notes
From the LBB: any net gain or loss from the re-creation of existing funds or accounts as exempted in this
bill are dependent upon the passage of another act of the 85th Legislature, Regular Session
(2017) and are dependent upon appropriations made in the 2018-19 General Appropriations
Act.
Bill Analysis
HB 3849 would abolish all funds and accounts created or re-created during the 85th legislature on the later of August 31st, 2017 or the date the act creating or re-creating the fund or account or dedicating or rededicating revenue takes effect. This would not apply to federal funds, trust funds, bond funds, constitutional funds, and additional uses for dedicated funds, and any funds, accounts, or revenue dedications abolished under this bill would be deposited to the
credit of the unobligated portion of the General Revenue Fund. As substituted in the Senate this bill would not apply to a lengthy list of specifically enumerated bills under consideration by the 85th legislature should they be enacted.
Vote Recommendation Notes
We originally supported this legislation as beneficial to transparency and accountability. With all of the exceptions now contained in this bill those benefits are significantly diminished. We have changed our position to neutral.
