Bill Caption

Relating to the service retirement annuity for certain members of the Judicial Retirement System of Texas Plan Two who resume service.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

Under current law, a retiree who resumes service as a judicial officer not through appointment or assignment are not allowed to rejoin or receive credit in the retirement system for the resumed service. HB 3263 amends this by allowing a retired judge to elect to rejoin and receive service credit in the Judicial Retirement System Plan Two if the retiree has been separated from judicial service for at least 12 consecutive months. If the election is successful, the retirement system shall recompute the service retirement annuity to include the retiree's additional service credit so long as it does not jeopardize the amortization period.

Vote Recommendation Notes

HB 3263 does not appear to have a connection to our liberty principles, therefore we remain neutral.
