Relating to the designation of a common area for on-premise consumption by a holder of certain alcoholic beverage permits and licenses.

Bill Analysis

HB 3089 would allow certain alcoholic beverage permit and license holders to designate a common area where an alcoholic beverage may be transferred to and sold, dispensed, or sampled for on-premise consumption. The common area would only be allowed to be located in certain areas. If an act that is grounds for suspension or cancellation of a permit or license occurs at an authorized common, the permit or license may be suspended or revoked. 

Alcoholic beverages transferred from the inventory of a permit or license into a designated common area must be documented, and would be subject to an excise tax. 

Vote Recommendation Notes

This legislation would give affected permit holders a little more flexibility in the use of their own product on their own premises. This is a step in the right direction of easing the regulatory burden on a highly regulated industry. We support HB 3089.
