Relating to an application for the amendment of a certificate of public convenience and necessity in an area within the boundaries of a political subdivision.

Bill Analysis

HB 2777 would allow a Class A utility to apply to the commission for an amendment of a municipal utility district's certificate of convenience and necessity. This would allow the utility to have the same rights and powers under the certificate as the municipal utility district. Criteria for the application and other related procedures regarding review and approval would be established. A utility that has applied applied for or been granted an amendment of a certificate not required to file a business plan to the executive director.
