No significant fiscal implication to the State is anticipated.
Bill Analysis
Under current law, theft is punishable as a state jail felony if the value of the property stolen in less than $2,500 and if the defendant has previously been convicted two or more times for any grade of theft. If this bill passes this crime could not be punishable as a state jail felony if the value of the property was less than $100. Instead a person would be charged with a Class A misdemeanor if the value of the property stolen is less than $100, and if the defendant had previously been convicted of two or more times of any grade of theft.
Vote Recommendation Notes
We support this bill’s efforts to defelonize the crime of theft if it is the individual’s third conviction, and if the value of the stolen property is under $100. For this bill’s role in reducing overcriminalization we support this bill.
