Bill Analysis

HB 2070 would amend the Occupations Code to extend the consideration of a reasonable number of attempts to conform a new motor vehicle to an applicable express warranty if the same nonconformity continues after four repair attempts from two of the repair attempts occurring within 12 months or 12,000 miles after the original delivery and the last two attempts occurring within 12 months or 12,000 miles after the second attempt to the attempts occurring before the date the warranty expires or 24 months or 24,000 miles following the delivery to the owner. The same extension would apply to a nonconformity that creates a safety hazard or substantially reduces the vehicle’s use or market value.
