Bill Analysis

HB 2019 would require the Texas Department of Housing & Community Affairs to provide to the public online information regarding manufactured home ownership records, lien records, installation records, license holder records, and other related information.

The Manufactured Housing Board would be mandated to conduct a cost benefit analysis for any rule, process, or policy change that would increase a fee or other incurred cost by more than $50 for license holders or consumers.

Procedures would be created for: real property appraisal and title work expenses; the manufactured homeowner consumer insurance claims program in place of the Manufactured Homeowners' Recovery Trust Fund;

Procedures would be updated for: rescissions of contract for sale or exchange; retailers acting as a warehouse; habitability; and lease purchases.

Location of the property would no longer be included in the department’s statement of ownership.


Vote Recommendation Notes

While we are neutral on many of the procedural changes and updates in this bill, we see no legitimate reason to codify into law the practice of publishing information relating to manufactured home ownership, lien records, installation records, etc. on the Texas Department of Housing & Community Affairs’ website. This information is already available from other sources to those who need access to it. Publishing this information about private homes on a state website violates our principles of limited government and individual liberty. For these reasons, we oppose this legislation.
