Bill Caption

Relating to a penalty for independent executors who misrepresent in an affidavit in lieu of the inventory, appraisement, and list of claims that certain beneficiaries received the inventory and appraisement.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

HB 1877 would allow a court to fine an independent executor in an amount not to exceed $1,000 if the court finds that the executor misrepresented in an affidavit that certain beneficiaries entitled to a verified, full, and detailed inventory and appraisement did in fact receive the inventory and appraisement to which they are entitled. The executor and his or her sureties would be liable for any fine and all damages and costs resulting from that misrepresentation. The fine, damages, and costs may be recovered in any court of competent jurisdiction.

Vote Recommendation Notes

HB 1877 does not appear to have a connection to our liberty principles, therefore we remain neutral.
