Bill Analysis

HB 1753 would allow the owner of a motor vehicle to transfer ownership to a designated beneficiary upon the owner's death. If there is joint ownership on the vehicle, all joint owners must designate the beneficiary. The designated beneficiary will be subject to all encumbrances, assignments, contracts, liens, and other interests related to the vehicle. This bill would specify the designation and transfer process, and would require the owner to include the name of the beneficiary on an application for a vehicle title for the designation to be effective.

Texas Action supports this bill. HB 1753 upholds our principles of individual liberty and property rights by creating a method for the legal transfer of property that would be held in statute. It enables friendly transactions and does not infringe on a citizen's right to use their property as they wish.
