Bill Analysis

HB 1290 would amend the Government Code to require a state agency to repeal at least one state agency rule before adopting a new one. This would not apply to a rule required by the legislature, a rule necessary to protect the health and safety of citizens, or certain rules in the Education Code. An agency would be required to prepare a proposed rule reduction statement that meets established criteria.

Vote Recommendation Notes

This legislation would, if properly carried out by state agencies, lead to a net reduction of government regulation over time. Ideally this legislation could be strengthened by ensuring that the negative economic impact of the repealed rule(s) be greater than the negative economic impacts of the new rule.
