Relating to disclosure regarding the existence of a gestational agreement in a suit for the dissolution of a marriage and standing of an intended parent under a gestational agreement to file a suit affecting the parent-child relationship.

Bill Analysis

Under current law, the petition in divorce proceedings must state whether there are children born or adopted who are under the age of 18. In addition to the existing statement, this bill would require the petition to state if one party to the marriage is pregnant, and if the parties have entered an agreement establishing a parent-child relationship. This bill would also specify the circumstances under which a person who is an intended parent of a child based on a gestational agreement has standing to file suit.

Vote Recommendation Notes

It is well within the proper role of government to set rules pertaining to child custody lawsuits. By clarifying who has grounds to file a suit, this bill neither offends nor uplifts our liberty principles. We will remain neutral on HB 1216.
