Bill Caption

Relating to ethyl alcohol monitoring as a condition of community supervision for certain intoxication offenses; authorizing the imposition of costs.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

This bill would allow a judge to require a defendant placed on community supervision to submit to ethyl alcohol monitoring for certain intoxication offenses. This bill would also allow the judge to require the defendant to pay for the alcohol monitoring device. A court would be required to "consider whether the defendant has previously failed to comply with an order requiring the installation and use of an ignition interlock device."

Vote Recommendation Notes

The provisions of this legislation provide an extra tool for courts to use when placing certain defendants on community supervision for alcohol related offenses. This does not affect our liberty principles and we remain neutral.
