Relating to liability of certain electric utilities that allow certain uses of land that the electric utility owns, occupies, or leases.

No significant fiscal implication to the State is anticipated.

Bill Analysis

Under current law, electric utilities may enter into a written agreement with a political subdivision to allow public access to property owned by the electric utility for recreation purposes. The utility under the agreement would subject to limited liability. However, this statute only applies to electric utilities located in a county with a population of four million or more.

 

HB 1166 would include adjacent counties in the limited liability.

Vote Recommendation Notes

This bill eases restrictions allowing for greater protections against possible tort related law suits. This protects property rights and limited government. We support HB 1166.
