Bill Analysis

SB 314 would require a court that appoints a nonparent as as managing conservator of a child to provide an explanation of differences between managing conservator and adoption, notably that managing conservator conveys rights only given by the court and a parent can still request visitation. The court order would include provisions that notify the nonparent of the authority to act on behalf of the child when various activities or care require parental consent. There must be evidence that the nonparent was advised of these rights and duties before appointment as managing conservator.

Vote Recommendation Notes

This bill does affirm the principle of personal responsibility, therefore we support this legislation. If legal responsibility for a child is assigned to an individual, the court should notify that individual of all the rights and responsibilities involved with that appointment.
