Bill Analysis

HB 2998 would propose the adoption of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act through an amendment of Chapter 1253 (Interstate Guardianships) of the Estates Code and addition of Chapter 1254 which addresses issues for guardianships and protective proceedings for adults. The bill would establish a scheme by which a  court can communicate with other courts regarding those issues and with out-of-state courts. The bill would allow out-of-state testimony by individuals for guardianship proceedings and establish the appropriate provisions concerning the testimony.  The bill would provide procedures for jurisdiction over a guardianship case, the transfer of guardianship to another state and the acceptance of guardianship from another state, and the registration and recognition of orders and guardianships from other states.

This bill has no discernible connection to the principles of liberty, but does provide a framework by which different courts, including out-of-state courts, can communicate with each regarding guardianship and protective orders. For this reason, we are neutral on HB 2998.
