Bill Analysis

HB 2991, if passed, would modify the Local Government Code (Subchapter Z, Chapter 212) regarding regulations of minimum setback requirements, related to mineral exploration and development. The two important components of the bill would require that any setback requirements which have already been adopted by a municipality, must be applied uniformly as a city expands. The second change would be that those with authority to develop tracts of land located within existing setbacks, may submit a waiver for an exception from the municipality.

Vote Recommendation Notes

HB 2991 represents a marginal increase in property rights protection. Given that the bill does not affect municipality laws, or municipality expansion, it actually represents modest protections in the form of forcing said parties to apply setback rule uniformly, and putting in place waiver allowances in code. As such, we support HB 2991.
