Bill Analysis
This legislation would amend the Transportation Code to create offenses of different classifications, for knowingly operating or
owning, leasing or assigning a person to drive a commercial motor vehicle. The violation would be a a Class A
misdemeanor, unless it is proven that the vehicle was involved in a motor vehicle accident that resulted in
bodily injury. If a death was a result of a violation of this law, it would become a second degree felony.
Vote Recommendation Notes
We are neutral on this legislation. While this legislation advocates for public safety and enforces penalties for those who drive a commercial vehicle unlawfully, we are unsure how this differentiates from the laws already on the books for penalties already in place for the very same offenses. We feel this legislation creates an unnecessary redundancy towards laws and penalties already in place and being enforced currently.
