Bill Analysis

Summary: SB 1156 would prohibit anyone on any land in Texas from using tires or scrap tires as a part of a land reclamation project without a permit from the Texas Commission on Environmental Quality (TCEQ). Under this legislation TCEQ would also be required to consult the municipality, county, groundwater conservation district, and regional planning commission before approving a permit.

Analysis: SB 1156 would represent a significant expansion of government regulation. Currently, TCEQ has its own rules for issuing permits but there is nothing in Texas law the requires individuals or businesses to receive a permit. SB 1156 would not just apply to large construction projects or projects on state land. SB 1156 would apply to every Texan doing land reclamation projects on own property. We oppose this legislation.
