Bill Analysis

Summary: The current Texas Insurance Code includes a section that requires individual accident and health insurance policies to contain a provision releasing the insurance company from liability if an accident or loss is the fault of the insured individual and that individual is under the influence of any narcotic not prescribed by a physician. HB 3105 repeals this section which would leave it up to the private insurance company and the individual to decide whether or not to include such a provision. 

Analysis: HB 3105 is a very clear limiting of government. It gives the individual and the insurance company a choice they did not have before. TPPA supports HB 3105.
