Bill Analysis

Summary: HB 2281 would clarify language in the Transportation and Occupations Code relating to salvage vehicle dealers and recyclers. Currently, ambiguity within the law makes it difficult for private businesses to ensure that they are complying with the law.

Analysis: When statute is ambiguous it makes compliance difficult and sometimes results in overcriminalization due to prosecution of people who thought they were in compliance with the law. HB 2281 would clarify statute to make the law more understandable and thus easier to obey. This will modestly limit government by decreasing the chance of an ambiguous law resulting in wrongful prosecution. We support this legislation.
