Bill Analysis

Summary: HB 2268 would allow law enforcement to obtain a search warrant for electronic information and serve it to an out of state company.

Analysis: Under current law, a law enforcement officer must apply for a search warrant in the jurisdiction in which the internet company resides. HB 2268 might make prosecution of internet crimes somewhat more efficient, however this legislation may also infringe on the jurisdiction of out of state governments. We are neutral on HB 2268.
