Bill Analysis

Summary: Under current law, law enforcement and attorneys must conduct an annual audit of asset forfeiture proceeds. HB 1849 would clarify the disposition and reporting process of forfeited property.

Analysis: This legislation does not add new cause for asset forfeiture, nor does it seek to eliminate current causes of asset forfeiture. While we are concerned about abuse of asset forfeiture, civil asset forfeiture in particular, this legislation does not address those issues. This is simply an administrative clarification bill. For that reason, HB 1849 does not fall under any of our liberty principles. We remain neutral on HB 1849.
