Bill Analysis

Summary: Under current law (Section 106.06 of the Alcoholic Beverage Code), providing alcohol to a minor is a Class A misdemeanor and concerns criminal negligence not intent. HB 1012 creates a new state jail felony for individuals who give alcohol to a minor and as a result the minor cause serious bodily injury or death to another.

Analysis: We agree that minors should not be provided with alcohol. However, we have some concerns with HB 1012. This bill shifts some of the responsibility for harm from the intoxicated minor to the supplier of alcohol. Also, this bill would make an individual presented with a fake ID who unknowingly gives alcohol to a minor a state jail felon. We recommend voting NO on HB 1012.
