Relating to the regulation of certain direct sales of food to consumers and a limitation on the fee amount for certain permits.
No significant fiscal implication to the State is anticipated.
SB 617 would clarify the law with respect to food sales at farmers markets to stipulate that the present $100 cap on farmers market food permits applies to all food producers, not just farmers. This would prevent local authorities from charging exorbitant permit fees to farmers market vendors who sell food products but are not farmers. The bill would also give permit holders recourse to bring action against a governmental entity that charges an annual fee in excess of $100 and recoup attorney’s fees along with the amount charged in excess.
