Relating to certain vocational nursing students providing essential services during a declared state of disaster.

No significant fiscal implication to the State is anticipated. 

Bill Analysis

SB 1856 would apply only to a student enrolled in an accredited school or program to become a licensed vocational nurse and is participating in a clinical program at a licensed facility. The services provided by such students would be considered essential services at all times in Texas, even during a state of disaster. SB 1856 would prevent a government entity from prohibiting such a student from providing essential services. 

Vote Recommendation Notes

While we do not disagree that the individuals this bill pertains to are providers of essential services, we strongly disagree with the notion that the state should determine who is and who is not an essential worker in the private sector during a state of disaster or at any other time. SB 1856 would violate the principles of limited government, the free market, and individual liberty. For these reasons, we oppose SB 1856.
