Relating to the municipal disannexation of certain areas formerly designated as a census designated place.
No fiscal implication to the State is anticipated.
SB 1499 would allow the Lost Creek neighborhood to formally disannex from the City of Austin. The special district serving this area would only be allowed to dissolve if the members of the governing body of the district elect to dissolve the district after the disannexation. The emergency services district that is located adjacent to this area would be allowed to provide services to the area.
Texas Action supports SB 1499. In 2019 HB 347 was passed to stop the practice of local government forcibly annexing areas, however, those areas that were forcibly annexed were not provided any recourse to disannex if the services they receive since being annexed are less than those they received prior to annexation. SB 1499 would allow a neighborhood that was forcibly annexed by the city of Austin and has not received the same or better services since annexation, to disannex from the city. This would promote the individual liberty and property rights of those living in this neighborhood who want to disannex.
