Relating to the applicability of the exemptions in the event of a disaster from certain limitations on the ad valorem tax rate of a taxing unit.
Passage of the bill would exclude epidemics as disasters that give taxing units the ability to raise tax rates above certain limits without having to hold an election, which may result in reduced tax revenues for school districts and impact costs to the state through the operation of the school funding formulas.
SB 1428 would stipulate that a taxing entity is prohibited from using a epidemic related disaster as a basis for exceeding the voter-approved tax rate without holding an election to get a new approved rate.
Texas Action supports SB 1428 as it would ensure taxing entities do not use epidemics, which no one can control, as a reason to increase a tax rate beyond what voters have approved. SB 1428 promotes limited government, property rights, and individual liberty.
