Bill Caption

Relating to adoption by law enforcement agencies of a mental health leave policy for peace officers.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

SB 1359 would require each law enforcement agency in the state to develop a policy allowing peace officers who experience a traumatic event to take mental health leave. The policy would have to provide clear and objective guidelines for which officers qualify, entitle officers to leave without a deduction in salary, enumerate the number of days available, and detail the level of anonymity for a peace officer who takes leave.

Vote Recommendation Notes

While SB 1359 would require law enforcement agencies to have a mental health leave policy, it grants the agencies leeway in developing policies that fit the needs of the specific agency. Texas Action is neutral on SB 1359 as it does not touch directly upon any of our Liberty Principles.
