Relating to the resumption of employment by certain retirees within the Texas Municipal Retirement System.

Bill Analysis

SB 1105 would modify municipal employee retirement law to allow municipal retirees to be re-employed by the municipality after a one year retirement period without having to forfeit retirement benefit payments during the subsequent employment period.

For example, the bill would require municipalities to discontinue and suspend the retirement benefits of a municipal employee who is reemployed by the same municipality at any time within the twelve month period from the effective date of the employee’s date of retirement. If the employee returns to work twelve months or longer from their retirement date, their retirement benefits would not be suspended. This is a change from the current waiting period of eight years. 


Vote Recommendation Notes

SB 1105 deals with administrative decisions that do not appear to affect our liberty principles. Texas Action remains neutral on SB 1105.
