Relating to the continuation of medical assistance for certain individuals.

HB 3761 would prevent the Health and Human Services Commission from suspending or terminating the eligibility of a recipient for medical assistance benefits if their ineligibility is caused partly or wholly by a technical or clerical error committed by the commission or an agent of the commission during the renewal application or other document required for benefits renewal.
HB 3761 would require the commission to coordinate with and inform relevant healthcare providers if a recipient is at risk of being determined ineligible for medical assistance benefits or is determined ineligible; and make reasonable efforts to ensure the medical assistance benefits of a recipient are not suspended or terminated. HB 3761 would require the commission to prepare and submit a report to the legislature regarding the suspension or termination of medical assistance benefits of recipients during the preceding state fiscal year.
HB 3761 seeks to ensure that recipients of the Medical Assistance Program continue to receive medical benefits during a minor technical or clerical error committed on or with respect to the recipient's renewal application or other document required for benefits renewal. HB 3761 therefore benefits the principle of limited government. Texas Action supports HB 3761.
