Relating to the authority of the Texas Department of Transportation to provide road services on federal military property.
No significant fiscal implication to the State is anticipated.
HB 3399 would allow the Texas Department of Transportation to enter unto an agreement with the United States Department of Defense or another federal entity to allow the TxDOT to assist in road services for military installations. The bill would prohibit state funds from being used to provide these road services or in instances when payment for these projects is made from funds provided to Texas under Title 23, United States Code.
Texas Action is neutral on HB 3399. While we remain neutral, there is concern about the State letting TxDOT enter into agreements of this sort as it would move the agency beyond its mission to provide for the "construction and maintenance of the state's immense state highway system, as well as overseeing aviation, rail, and public transportation systems in the state" (txdot.gov). The maintenance of the state's highways should be a priority before expanding the ability of TxDOT to maintain roads outside their current jurisdiction.
