The bill would have a negative impact of ($6,891,680) to General Revenue Dedicated Statewide Electronic Filing System Account 5157 through the biennium ending August 31, 2023.
The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.
HB 3334 would require the Office of Court Administration to create and maintain a criminal sentencing database that includes detailed information for each person convicted of a jailable offense. The Office would have to publish the de-identified sentencing data maintained in the database on their website for the public. Individual information in the database would not be required to be removed if someone has a previous conviction expunged from their record.
Texas Action opposes HB 3334 because it would unnecessarily expand government. While furthering data collection can give lawmakers better information, spending millions of taxpayer dollars doing so is not a worthy tradeoff. HB 3334 would also keep a person's conviction information in the state database after they have had their records expunged, thus restricting that person's privacy in the future.
