Bill Analysis

HB 3028 would prohibit an insurer or health benefits plan issuer, life insurance policy, property and casualty insurance policy, or any other insurance policy written for a business from requiring that all of the business' employees be vaccinated as a condition to purchase or maintain coverage.

Vote Recommendation Notes

Texas Action opposes HB 3028. As much as we would be disappointed to see an insurance company mandate vaccinations, it is not the government's job to tell an insurer what it must not cover any more than it is the government's job to tell an insurer what it must cover.

We have elsewhere supported bills this session that prohibit units of government from doing business with entities that work against the firearms industry or the oil and gas industry. We would withdraw our objection if the bill was amended to, rather than create a blanket prohibition, simply prohibit the state or any political subdivision of the state from doing business with any entity that requires a vaccine of its customers.
