Relating to the enforcement by the secretary of state of certain voter roll maintenance provisions; creating a criminal offense.
No significant fiscal implication to the State is anticipated.
HB 2546 would require the secretary of state to monitor each court clerk and voter registrar for compliance with existing law regarding maintenance of voter rolls. If the secretary of state determines that a court clerk or voter registrar has failed to comply with applicable laws, the secretary of state would, for a first violation, require the clerk or registrar to attend a training, for the second offense, audit the voter registration list for that county and determine steps to achieve compliance, and for a third offense, inform law enforcement that an offense may have been committed. An offense under this provision would be a state jail felony.
Texas Action supports HB 2546 because it espouses the limited government and individual liberty principles by making Texas elections more secure. This bill would enact additional security to Texas elections by making sure election officers comply with voter roll maintenance laws. Proper maintenance of Texas voter rolls is an important facet of election integrity.
