Bill Caption

Relating to the breach of development agreement contracts governing land in the extraterritorial jurisdiction of certain municipalities.

Fiscal Notes

No fiscal implication to the State is anticipated.

Bill Analysis

HB 1929 would change the law so that annexation by a municipality of land subject to a contract between a governing body and landowner does not invalidate the enforceability of the contract or infringe on the rights of a party to adjudicate a claim arising under the contract. HB 1929 would waive a municipality's immunity from suit for the purpose of adjudicating a claim for breach of the contract. HB 1929 would also allow actual damages, specific performance, or injunctive relief to be granted in a suit brought against a municipality for breach of contract but sets limits on the total amount of money that can be awarded, such as balance due under contract, debt incurred by landowner due to breach, attorneys fees, and interest.

Vote Recommendation Notes

Texas Action supports HB 1929 which is in alignment with our limited government, private property rights, and individual liberty principles.
