Relating to the civil liability of a children's isolation unit in a hospital.
No significant fiscal implication to the State is anticipated.
HB 1914 would limit civil liability for a children’s isolation
unit at a hospital. Specifically, a children’s isolation unit that has instituted
isolation protocols would not be liable for any claim, damage, or loss
arising from the provision of health care services to children with
highly contagious diseases, unless the act or omission proximately
causing the claim, damage, or loss constitutes gross negligence or
wilful misconduct.
HB 1914 effectively extends qualified immunity to children's isolation units, significantly limiting the recourse available to the family of a child in an isolation unit in the event of damage or loss arising from the provision of care at such a unit. Texas Action opposes HB 1914 which is inconsistent with individual liberty and limited government.
