Relating to municipal and county permitting requirements to conduct certain repairs on residential buildings.
No fiscal implication to the State is anticipated.
HB 1878 would require a municipality or county to allow an owner of a damaged residential building to immediately begin emergency repairs to the damaged residential building if doing so protects public safety, prevents further damage, or protects the overall structural integrity. The building owner must apply for an emergency permit either 3 days after repairs commence or 3 days after a municipality or county is able to accept an emergency permit application. The governor would not have the power to exempt a municipality or county from this bill by executive order. A residential property owner may bring legal action against a municipality or county if the municipality prohibits the owner from taking proper action under this bill.
