Fiscal Notes

Estimated Two-year Net Impact to General Revenue Related Funds for HB1284, As Engrossed : an impact of $0 through the biennium ending August 31, 2023. The bill would make no appropriation but could provide the legal basis for an appropriation of funds to implement the provisions of the bill.

Bill Analysis

HB 1284 would transfer authority over the injection and geologic storage of carbon dioxide from the Texas Commission on Environmental Quality (TCEQ) to the Texas Railroad Commission (RRC). Various conforming changes would be made. The RRC would be given enforcement authority associated with related civil, administrative, and criminal penalties. 

HB 1284 would prohibit the RRC from issuing a permit for the conversion of a previously plugged and abandoned Class I injection well to a Class VI injection well. The bill would require applicants for a new well permit to get a letter of determination from the Texas Commission on Environmental Quality stating their well will not interfere with an existing well or waste plume.
