Relating to prohibiting organ transplant recipient discrimination on the basis of certain disabilities.
No significant fiscal implication to the State is anticipated
HB 119 would prevent healthcare providers from discriminating solely on an individual's disability in determining eligibility for organ transplant services. The bill proscribes the considerations which must be taken into account when determining a disabled individual's eligibility for an organ transplant.
While we prefer that the legislature not dictate the terms on which medical decisions are made, the state does have a legitimate interest in prohibiting the withholding of life-saving medical treatment solely based on a patient's disability status; particularly if the health care provider or facility are recipients of public funds. For these reasons we remain neutral on HB 119.
