Bill Caption

Relating to immunity from liability of a school district or open-enrollment charter school for certain actions of security personnel.

Fiscal Notes

No significant fiscal implication to the State is anticipated.

Bill Analysis

SB 811 would provide immunity for a school district or open-enrollment charter school for any reasonable action taken by security personnel to maintain the safety of the campus, including action relating to possession or use of a firearm. This immunity also extends to damages resulting from reasonable action taken by a district or school employee who has written permission from the board of trustees or governing body of the school to carry a firearm on campus. Immunity provided by this bill would not preempt current standing laws and immunity.

Vote Recommendation Notes

Texas Action remains neutral on SB 811 because it does not affect our liberty principles. We note, however, that this appears to be sound public policy.
