Bill Analysis

SB 230 would add "rock climbing" to the definition of "recreation." Landowners who give people access to their land for purposes of recreation do not assume the land is safe for that purpose and do not incur liability for any injury. 

Vote Recommendation Notes

Texas Action supports SB 230 because it advances the principle of personal responsibility. Individuals who are using land for a recreational activity should inspect if the land is safe and assume the risk of injury by engaging in a recreational activity. The landowner should not be responsible for any injury the individual engaging in the recreational activity incurs.
