Relating to the delivery of alcoholic beverages by the holder of a wine and beer retailer's permit.
No significant fiscal implication to the State is anticipated.
A wine and beer retailer's permit authorizes the holder to sell on or off the premises beer, ale, malt liquor, or wine not more than 14% or 17%. A local cartage permit authorizes warehouse or transfer companies to transport liquor inside the corporate limits of any city or town. These permits may also be issued to package store and wine-only package store permittees to deliver liquor to customers within the city, and transport liquor within the same county between his or her other licensed premises.
SB 1232 would make wine and beer retailer's permit holders eligible to apply for a local cartage permit, thereby allowing the permit holders to make such deliveries and collections from ultimate consumers in the same manner as a package store permit holder.
Texas Action recommends supporting SB 1232 because it promotes limited government and free market principles. With the delivery of alcoholic beverages becoming increasingly popular, this bill would allow wine and beer retailer's permit holders to be more competitive and would reduce unnecessary restrictions on these retailers.
