Relating to the provision of solid waste disposal services in the extraterritorial jurisdiction of certain municipalities.

Bill Analysis

HB 3045 would allow certain counties to offer, require the use of, and charge a fee for solid waste disposal services in the extraterritorial jurisdiction (ETJ) of a municipality. This bill also prohibits such a municipality from providing solid waste disposal services or charging a fee in the ETJ if the county provides those services under the bill's provisions. 

Vote Recommendation Notes

This is a local issue to resolve a dispute between a county and a municipality about solid waste disposal services in the county's ETJ. It is of no consequence to our liberty principles which of these government entities is responsible for these services in this ETJ. Either way, citizens will be required to use one or the other of their solid waste disposal services. 

On a related note, we encourage the legislature to consider the possibility of prohibiting units of government from requiring use of their solid waste disposal services. This places government in a position to have a monopoly over these services and precludes the potential innovations and lower prices for consumers which would accompany private sector competition in this area.
