HB 2790 would repeal the section of the Alcoholic Beverage Code that considers it prima facie evidence (meaning evidence sufficient to raise a presumption) of intent to sell if someone possesses one quart of liquor or more than 24 twelve-ounce bottles of beer in a dry area.
Texas Action supports HB 2790 for promoting the principles of individual liberty and limited government. This is a common sense bill that would repeal an outdated law which unfairly creates a presumption of intent to sell.
