Relating to the execution of a search warrant for taking a blood specimen from certain persons in certain intoxication offenses.
No significant fiscal implication to the State is anticipated.
HB 1355 would allow for a police officer to execute a warrant to take a blood sample of a person suspected of committing an intoxication offense, such as a DWI or Intoxicated Manslaughter, in counties adjacent to the county that the warrant was issued. The police officer would have to be authorized to make an arrest in the county in which the warrant was executed.
This is a local procedural bill which does not affect our liberty principles because it does not diminish the civil rights of defendants for whom a warrant has been issued for a blood draw. For these reasons we remain neutral.
