Fiscal Notes
There would be an indeterminate positive fiscal impact to the state due to the number of administrative penalties; the number of authorizations and renewals that would be issued; the number of inspections and tests that would be conducted; and amounts for authorization, testing, and inspection fees that would be established being unknown.
Bill Analysis
HB 1325 would create the Hemp Farming Act which concerns the production and
regulation of low-THC hemp and products made from hemp. This bill would allow the development of new
commercial markets for farmers and businesses through the sale of hemp-related products and promote the expansion of this state’s hemp industry to the
maximum extent permitted by law. The bill would allow farmers and businesses to cultivate, handle, and process hemp
while also being able to sell hemp products
for commercial purposes. HB 1325
would also encourage the research of hemp production and hemp products at institutions of higher education and in the private sector.
Vote Recommendation Notes
While we do not necessarily endorse the entire regulatory framework proposed by this legislation, we support HB 1325 because it uplifts our principles of limited government, individual liberty, and free markets. This bill would allow for the legal cultivation, research, and sale of hemp and associated products. Legalizing hemp and associated products are would increase the economic opportunities available to Texans.
