Bill Analysis

Under current law, automatic license plate readers are not regulated as to their use by law enforcement. This bill would amend that part of the code by regulating and limiting the use of license plate readers to investigating a criminal offense or investigating a report of a missing person. Also, all images and data produced from an automatic license plate reader under this section must be destroyed not later than the first anniversary of the date of collection, unless it is evidence of an ongoing criminal investigation.

Vote Recommendation Notes

This bill supports the principle of limited government and individual liberty by making it clear that license plate readers can only be used for actual criminal investigations. Perhaps the best part of the legislation is the fact that the data gathered from the reader must be destroyed in a timely fashion. This ensures that the state is not retaining records to surveil citizens, infringing on 4th amendment rights. Because of these positive impacts on our principles, we support this legislation.
