Relating to the use of photographic traffic signal enforcement systems.

Bill Analysis

Current law states that the use of photographic traffic signal enforcement systems to enforce certain traffic violations is permissible. 

 

SB 88, if enacted, would amend current Transportation Code by adding section 707.020 which would prohibit the use of photographic traffic signal enforcement systems from enforcing civil or criminal offenses. 

 

The bill, however, would make exceptions and does expand the definition of photographic traffic signal enforcement systems from current statute.  As in section 707.0015 and 707.0016 both toll enforcement and law enforcement use is acceptable respectively.  Furthermore, 707.0016 codifies the specific circumstances that law enforcement would be exempt from the prohibition of photographic traffic signal enforcement systems.

Vote Recommendation Notes

Unfortunately, photo-enforcement is often used as a revenue generator under the guise of public safety. We support SB 88 because getting rid of photo-enforced traffic citations would support our principle of limited government.
