Bill Analysis

Under current law, a hospital has a lien on a cause of action or claim of an individual who receives hospital services for injuries caused by an accident that is attributed to the negligence of another person. For the lien to attach, the individual must be admitted to a hospital no later than 72 hours after the accident. SB 2066 would repeal the requirement that the individual be admitted and instead require the individual to have received services from a hospital no later than 72 hours after the accident. 

Vote Recommendation Notes

This bill enhances our personal responsibility principle by requiring a person to receive treatment from a hospital rather than simply be admitted in order for a hospital to impose a lien on a cause of action, court judgement, or settlement proceeds. This would impose a more clear standard as to when a hospital may have a lien based on services received instead of an individual simply being admitted.
